In addition to the Sony Ericsson Legal Notice including User Terms and Privacy Notice available at www.sonyericsson.com/Legal, you hereby accept that the following "Terms of Service" apply to the Mobile Client Prototype Application ("Hanashi") provided by Sony Ericsson Mobile Communications AB, Nya Vattentornet, 221 88 Lund, Sweden ("Sony Ericsson") at http://hanashi.nu/. Reference to Sony Ericsson includes reference to its "Affiliates". Sony Ericsson may modify these Terms of Service at any time, and you agree to be bound by such modifications. If you do not accept and abide by this Terms of Service, you may not use the Hanashi or download or use any related software.

1. The Hanashi is a mobile to mobile instant messaging client, on a research stage, which may be downloaded from http://hanashi.nu/, or spread between handsets when used.

2. THE Hanashi IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SONY ERICSSON DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR THE AVAILABILITY, TIMELINESS, SECURITY OR RELIABILITY OF THE Hanashi AND ANY RELATED SOFTWARE.

3. Sony Ericsson may modify, suspend or discontinue the Hanashi with or without notice at any time and without any liability to you.

4. You are responsible for the information you provide to Sony Ericsson and for any consequences thereof. You agree that you will use the Hanashi and any related software in compliance with all laws and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all United States export control laws. You will not and will not allow any third party to: (i) use the Hanashi or any related software to upload, transmit or otherwise distribute any content that is misleading, unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable; (ii) upload, transmit or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary rights; or, (iii) use the Hanashi for any fraudulent or inappropriate purpose. Violation of any of the foregoing may result in immediate termination or of denying access to the Hanashi.

5. As a condition to use the Hanashi and, if applicable, the related software, you agree to the terms of Sony Ericsson User Terms and Privacy Notice at www.sonyericsson.com/Legal, You agree that Sony Ericsson may access or disclose your personal information, including the content of your communications, if Sony Ericsson is required to do so in order to comply with any valid legal process, or as otherwise provided in these Terms of Service and the Sony Ericsson Privacy Notice. Personal information collected by Sony Ericsson may be stored and processed in the United States or any other country in which Sony Ericsson Mobile Communications AB, its affiliates, contractors or its agents maintain facilities. By using the Hanashi, you consent to any such transfer of information outside of your country.

6. SONY ERICSSON HAS NO RESPONSIBILITY OR LIABILITY FOR THE DELETION OF, OR THE FAILURE TO STORE OR TO TRANSMIT, ANY CONTENT AND OTHER INFORMATION MAINTAINED OR TRANSMITTED BY THE Hanashi. SONY ERICSSON IS NOT RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OR ADVICE TRANSMITTED THROUGH THE Hanashi. SONY ERICSSON MAY, AT ANY TIME, LIMIT USE AT ITS SOLE DISCRETION. SONY ERICSSON TAKES NO RESPONISBILITY FOR THIRD PARTY CONTENT.

7. You acknowledge that Sony Ericsson owns all right, title and interest in and to the Hanashi and to the related software

8. The Sony Ericsson logo is the trademark or registered trademark of Sony Ericsson Mobile Communications AB. Sony is the trademark or registered trademark of Sony Corporation. Ericsson is the trademark or registered trademark of Telefonaktiebolaget LM Ericsson.

9. Cost for using the Hanashi may vary from country to country. You are responsible for any costs or expenses incurred as a result of use of the Hanashi (including without limitation SMS costs and roaming charges). Check with your local service provider for current charges.

10. These Terms of Service are governed by the laws of Sweden, excluding its conflict of laws provisions. You further consent to the jurisdiction of the Swedish courts.
